Regulamin korzystania z aplikacji „Dr Volovyk”
Data publikacji: 2026-10-09 · Data wejścia w życie: 2026-10-26 (poprzednia wersja: 2026-09-01). Niniejsza wersja obejmuje funkcje wprowadzone w Aplikacji w wersjach 1.2–1.8 (rejestracja Konta w Aplikacji, oświadczenia i zgody składane w Aplikacji, automatyczne powiązanie wyników z Kontem, zapis wyników do pliku, ekran informacyjny, od wersji 1.7 – Konto personelu Gabinetu w Aplikacji, a od wersji 1.8 – powiadomienia o wcześniejszym terminie wizyty).
1. Postanowienia ogólne i definicje
1.1. Niniejszy Regulamin określa zasady korzystania z aplikacji mobilnej „Dr Volovyk” (dalej: Aplikacja) – prywatnego portalu klienta gabinetu Dr. Volovyk, w którym Klient zakłada Konto, składa oświadczenia i zgody wymagane przez Gabinet, rezerwuje wizyty w Gabinecie oraz uzyskuje wgląd we własne wyniki testów i ocen paramedycznych/wellness po odbytej wizycie.
- Konto – zbiór danych i uprawnień przypisanych do Klienta w Aplikacji, umożliwiający uwierzytelnienie, rezerwację wizyt i dostęp do wyników.
1.6. Podział ról i odpowiedzialności.
2.3. Charakter Usługi oraz czego Aplikacja i Usługa NIE stanowią. Usługa ma charakter wyłącznie paramedyczny/wellness. W szczególności:
- Usługa nie jest świadczeniem zdrowotnym w rozumieniu przepisów o działalności leczniczej;
- Aplikacja nie jest wyrobem medycznym (urządzeniem medycznym) w rozumieniu obowiązujących przepisów;
- Usługa ani Aplikacja nie stanowią diagnozy ani oceny medycznej;
- Usługa ani Aplikacja nie stanowią porady medycznej ani zaleceń terapeutycznych;
- nie zastępują konsultacji lekarskiej ani opieki lekarskiej;
- Aplikacja nie analizuje ani nie interpretuje treści udostępnionych wyników w imieniu Klienta.
2.4. Aplikacja służy wyłącznie udostępnianiu Klientowi jego wyników ocen paramedycznych/wellness i ma charakter informacyjny.
2.5. Zapis wyników do pliku (eksport).
2.6. Ekran informacyjny.
3. Rejestracja, wymagania dostępu i Konto
3.1. Rejestracja.
Klient powinien ustanowić hasło trudne do odgadnięcia i nieużywane w innych usługach.
3.7. Konto rodzinne i Członkowie konta.
- podaje i aktualizuje dane Członków konta oraz dane uczestników wizyt i odpowiada za ich prawidłowość;
- oświadcza, że jest uprawniony do działania w imieniu Członków konta – w przypadku dzieci jako rodzic lub opiekun prawny;
Aplikacja zapisuje treść (w postaci wersji i skrótu kryptograficznego), decyzję i datę złożenia każdego Oświadczenia.
3a.2. Uwierzytelnianie i sesja.
3a.3. Obowiązki osoby korzystającej z Konta personelu. Osoba z Personelu zobowiązana jest w szczególności do:
- zachowania w poufności danych klientów Gabinetu, w tym danych dotyczących zdrowia, także po ustaniu upoważnienia;
- zachowania w poufności danych logowania oraz drugiego składnika uwierzytelniania i nieudostępniania Konta personelu innym osobom, w tym innym osobom z Personelu;
- korzystania z Konta personelu wyłącznie w celu obsługi klientów Gabinetu i wyłącznie w zakresie niezbędnym do wykonania konkretnej czynności;
- niezwłocznego zgłoszenia Administratorowi podejrzenia nieuprawnionego dostępu do Konta personelu, w tym po otrzymaniu wiadomości o zalogowaniu z nieznanego urządzenia;
3a.4. Ograniczenia i rejestr dostępu.
4.2. Zabronione jest w szczególności:
- podejmowanie prób nieuprawnionego dostępu do Aplikacji, jej systemów lub danych innych osób;
- podawanie nieprawdziwych danych, w tym cudzego imienia i nazwiska lub cudzej daty urodzenia, w celu uzyskania dostępu do wyników innej osoby;
- zakładanie Konta lub dodawanie Członka konta w imieniu osoby, do reprezentowania której Klient nie jest uprawniony;
- korzystanie z cudzego Konta lub udostępnianie własnego Konta innym osobom;
- ingerowanie w działanie Aplikacji, jej zabezpieczenia lub infrastrukturę;
- podejmowanie działań mogących zakłócić funkcjonowanie Usługi lub naruszyć jej bezpieczeństwo (w tym masowe zakładanie Kont lub Rezerwacji);
- wykorzystywanie Aplikacji do celów niezgodnych z prawem.
5. Charakter wyników i brak porady medycznej
5.1. Wyniki udostępniane w Aplikacji mają charakter wyłącznie informacyjny i paramedyczny/wellness.
- dla Kont założonych przed wersją 1.4 – na podstawie Kartoteki Gabinetu, jak dotychczas;
6. Rezerwacja wizyt, przypomnienia i powiadomienia
6.1. Rezerwacja. Aplikacja umożliwia Klientowi zarezerwowanie terminu wizyty w Gabinecie: wybór usługi z cennika Gabinetu (nazwa, czas trwania, cena), wybór wolnego terminu oraz wskazanie uczestników wizyty spośród Użytkownika głównego i Członków konta (imię i nazwisko oraz numer telefonu każdego uczestnika). Rezerwacja jest zapisywana w terminarzu (kalendarzu) Gabinetu. Rezerwacja wymaga uprzedniego złożenia wymaganych Oświadczeń (pkt 3.8).
6.2. Potwierdzenie Rezerwacji.
6.3. Rezerwacja dokonana w Aplikacji stanowi zarezerwowanie terminu wizyty w Gabinecie; sama usługa jest świadczona i opłacana w Gabinecie (zob. pkt 1.5). Ceny widoczne w Aplikacji pochodzą z cennika Gabinetu.
6.5. Przypomnienia i potwierdzanie wizyt.
6.11. Rezerwacje, przypomnienia i potwierdzenia wizyt mają charakter organizacyjny (obsługa terminarza Gabinetu) i nie stanowią świadczenia zdrowotnego, diagnozy ani porady medycznej.
7. Własność intelektualna
7.1. Aplikacja, jej kod, interfejs, nazwa, logo, układ graficzny oraz inne elementy podlegają ochronie prawnej i przysługują Dostawcy Aplikacji (Media Friends) lub podmiotom, od których Dostawca Aplikacji uzyskał odpowiednie prawa. Treść ekranu informacyjnego (pkt 2.6) pochodzi ze strony internetowej Gabinetu i podlega prawom Usługodawcy Wellness.
8. Dostępność Usługi i wyłączenie gwarancji
8.1. Dostawca Aplikacji (Media Friends) dokłada starań, aby Aplikacja działała prawidłowo i była dostępna w sposób ciągły, jednak nie gwarantuje nieprzerwanej dostępności.
8.2. Aplikacja jest udostępniana w stanie „takim, w jakim jest” („as is”).
8.3. Możliwe są przerwy techniczne wynikające z konserwacji, aktualizacji, awarii lub działania podmiotów trzecich (np. dostawców infrastruktury, dostawców usług doręczania powiadomień, hostingu strony internetowej Gabinetu). Dostawca Aplikacji w miarę możliwości będzie informował o planowanych przerwach.
8.4. Dostawca Aplikacji nie gwarantuje doręczenia każdego powiadomienia push lub wiadomości e-mail (doręczanie zależy m.in. od ustawień urządzenia, operatorów i dostawców zewnętrznych). Przypomnienia mają charakter pomocniczy – brak przypomnienia nie zwalnia Klienta z dbałości o umówione terminy.
- niemożności skorzystania z Aplikacji lub przerw w jej działaniu;
- nieuprawnionego dostępu do Konta wynikającego z niezachowania poufności danych logowania przez Klienta;
- niedoręczenia powiadomienia lub przypomnienia z przyczyn niezależnych od Dostawcy Aplikacji (zob. pkt 8.4);
- opóźnienia lub braku automatycznego Powiązania wyników wynikającego z niezgodności danych podanych przez Klienta z danymi Gabinetu (sekcja 5a);
9.4. Postanowienia Regulaminu nie naruszają praw Klienta będącego konsumentem wynikających z bezwzględnie obowiązujących przepisów prawa.
10. Usunięcie i zawieszenie Konta
- naruszenia Regulaminu, w szczególności zasad korzystania (sekcja 4);
- podejrzenia nieuprawnionego dostępu lub nadużycia, w tym podania nieprawdziwych danych w celu uzyskania dostępu do wyników innej osoby;
- braku możliwości potwierdzenia tożsamości Klienta przez Gabinet;
- zakończenia relacji Klienta z Gabinetem;
10.5. Zawieszenie Konta personelu i odebranie uprawnienia. Konto personelu zostaje zawieszone, a uprawnienie odebrane niezwłocznie w przypadku:
- utraty upoważnienia, w szczególności ustania współpracy osoby z Personelu z Administratorem;
- naruszenia obowiązku poufności lub innych obowiązków określonych w sekcji 3a;
- podejrzenia nieuprawnionego dostępu do Konta personelu lub nadużycia;
6 ust. 1 lit. b RODO); zapis złożonych Oświadczeń oraz rejestr Powiązania wyników prowadzone są w celu wykazania zgody i zapewnienia bezpieczeństwa danych, a rejestr dostępu personelu – w celu rozliczalności dostępu do danych (art. 6 ust. 1 lit. c RODO w związku z art. 32 RODO oraz art. 6 ust. 1 lit. f RODO); szczegóły zawiera Polityka prywatności.
11.4. Obsługa praw Klienta dotyczących danych osobowych (m.in. dostęp, sprostowanie, ograniczenie przetwarzania, wycofanie zgody) realizowana jest przez Administratora, tj. Volovyk Clinic. Szczegóły dotyczące podstaw przetwarzania, odbiorców danych, okresów przechowywania oraz praw Klienta zawiera Polityka prywatności.
12. Zmiany Regulaminu i data wejścia w życie
Akceptacja nowej wersji Regulaminu następuje w Aplikacji (pkt 3.8).
12.3. Niniejszy Regulamin został opublikowany dnia 2026-10-09 i obowiązuje od dnia 2026-10-26 (poprzednia wersja z dnia 2026-09-01).
13. Prawo właściwe, kontakt i rozwiązywanie sporów
13.1. Prawo właściwe. Regulamin podlega prawu polskiemu.
13.3. Pozasądowe rozwiązywanie sporów konsumenckich. Klient będący konsumentem ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, m.in.: (a) z platformy internetowego rozstrzygania sporów (ODR) Unii Europejskiej dostępnej pod adresem https://ec.europa.eu/consumers/odr; (b) z pomocy stałych polubownych sądów konsumenckich, wojewódzkich inspektoratów Inspekcji Handlowej oraz powiatowych (miejskich) rzeczników konsumentów. Skorzystanie z tych metod jest dobrowolne.
13.4. Spory nierozwiązane polubownie podlegają rozstrzygnięciu przez właściwy sąd zgodnie z przepisami prawa.
Terms of Service for the “Dr Volovyk” Application
Publication date: 2026-10-09 · Effective date: 2026-10-26 (previous version: 2026-09-01). This version covers the features introduced in Application versions 1.2–1.8 (Account registration in the Application, statements and consents given in the Application, automatic linking of results to the Account, saving results to a file, information screen, as of version 1.7 – a Practice staff account in the Application, and as of version 1.8 – notifications about an earlier appointment slot).
1. General provisions and definitions
1.1. These Terms of Service (the Terms) set out the rules for using the “Dr Volovyk” mobile application (the Application) – a private client portal of the Dr. Volovyk practice, in which the Client creates an Account, gives the statements and consents required by the Practice, books appointments at the Practice, and gains access to their own paramedical/wellness test and assessment results after a completed visit.
1.2. Two separate entities are involved in providing and maintaining the Service:
Application Provider (Service Provider) – Media Friends Sp. z o.o., with its registered office at Aleje Jerozolimskie 155 / U3, 02-326 Warszawa, Tax ID (NIP) 5291821424, Register number (KRS) 0000730783, contact address: hello@mediafriends.pl (the Application Provider or Media Friends). Media Friends is the developer and publisher of the Application in the Apple App Store and Google Play, and provides and technically maintains the Application together with its backend infrastructure.
Paramedical/wellness service provider / Data Controller – Volovyk Clinic Sp. z o.o., with its registered office at Aleje Jerozolimskie 155 / U3, 02-326 Warszawa, Tax ID (NIP) 5291821045, contact address: kontakt@doctorvolovyk.com (the Wellness Provider, the Controller, or the Practice). Volovyk Clinic carries out activities of a paramedical/wellness nature, performs tests and assessments within that scope, and is the controller of the Client’s personal data, including data concerning health, within the meaning of the GDPR. The activities of Volovyk Clinic do not constitute the provision of a health service within the meaning of the legislation on medical activity.
1.3. Definitions used in these Terms:
- Service – providing the Client, through the Application, with: (a) access to their own paramedical/wellness test and assessment results (data concerning health) in electronic form (including PDF files) and the ability to save them to a file, (b) the ability to book, cancel, and confirm an appointment at the Practice, (c) notifications and reminders related to appointments, (d) the ability to give the statements and consents required by the Practice, and (e) an information screen about the method used at the Practice. The Application merely makes available to the Client their own test and assessment results produced by the Wellness Provider; it does not create or modify such content.
- Client or User – a natural person aged 16 or over who holds an Account in the Application and uses the Application; a person aged 16–18 uses the Application with the knowledge and consent of their legal representative.
- Account – the set of data and permissions assigned to the Client in the Application, enabling authentication, appointment booking, and access to results.
- Staff – a person authorized by the Controller (Volovyk Clinic) to service the Practice’s clients, using the Application on a Staff account.
- Staff account – a separate type of account in the Application, assigned to a member of the Staff, enabling access to the Practice’s day schedule, the person register, a person’s card together with their results, and the handling of results-Linking review cases. A Staff account cannot be created independently – the authorization is granted solely by the Controller. A Staff account is not a Client’s Account and does not serve to use the Service in the capacity of a Client (section 3a).
- Registration – creating an Account in the Application: confirming the e-mail address with a one-time code, providing personal details (first name, last name, date of birth, phone number), giving the Statements, and setting a password.
- Statements – the information on the processing of personal data and the statements and consents presented in the Application (including acknowledgement of the information on data processing, explicit consent to the processing of data concerning health, the parent/legal guardian statement, voluntary contact consents), replacing the statement previously completed on paper at the Practice.
- Primary user – the Client who logs in to the Application and manages the Account, including the list of Account members and bookings.
- Account member – a person added to the Account by the primary user (a family member, including a child), for whom the primary user may book appointments and view results.
- Linking of results – the assignment of test/assessment results to the Account or an Account member, carried out by the systems supporting the Service in accordance with section 5a.
- Booking – a reservation, made in the Application, of an appointment slot at the Practice for a selected service from the Practice’s price list.
- Practice – the Dr. Volovyk practice operated by the Wellness Provider (Volovyk Clinic Sp. z o.o.), providing services of a paramedical/wellness nature.
- Practice records – the register of persons kept in the Application’s system (first name, last name, e-mail address), on the basis of which results were linked to Accounts created before version 1.4 of the Application. Entries imported from the Practice’s spreadsheet remain in the register; as of version 1.6 the spreadsheet ceases to be the only source of the linking of results (the Practice calendar takes over that role) and is being phased out.
- Practice calendar – the calendar in which the Practice records appointment dates – both those booked in the Application and those arranged on the website or by phone.
1.4. Using the Application constitutes acceptance of these Terms. A Client who does not accept these Terms should not use the Application.
1.5. The Application is provided free of charge. It contains no in-app purchases and no advertising. Practice services booked through the Application are payable at the Practice in accordance with the price list shown at the time of booking; the Application does not collect or intermediate payments.
1.6. Division of roles and responsibilities. The parties perform different roles within the Service:
- Media Friends (Application Provider) is responsible for the technical operation of the Application, its availability, distribution in the app stores, and technical support. With respect to the Client’s personal data, Media Friends acts as a processor on behalf of and on the instructions of the Controller, on the basis of a data processing agreement (Article 28 GDPR).
- Volovyk Clinic (Wellness Provider / Controller) is responsible for the content and accuracy of the paramedical/wellness assessment results made available, for the provision of paramedical/wellness services, for the content of the Statements, for decisions on the Linking of results requiring review, and for handling the Client’s rights concerning personal data (as the Controller). Volovyk Clinic determines the purposes and means of processing the Client’s personal data. Volovyk Clinic authorizes members of the Staff to use Staff accounts, defines the scope of that authorization, and is responsible for the way those accounts are used (section 3a).
2. Scope of the Service
2.1. The Service consists in enabling the Client to: (a) view their own paramedical/wellness test and assessment results produced by the Practice and made available in the Application in electronic form, and save them to a file on their own device (clause 2.5), (b) book, cancel, and confirm an appointment at the Practice (section 6), (c) receive notifications and reminders related to appointments, (d) give the Statements required by the Practice (clause 3.8), and (e) read the information screen about the method used at the Practice (clause 2.6).
2.2. The Client has access solely to their own results and to the results of Account members added to their Account, once these have been Linked in accordance with section 5a. The Application does not make available to the Client the results or data of other persons. Members of the Staff using a Staff account have access to the data of the persons whose service requires it, and solely to the extent necessary to perform it; every such access is recorded in the staff access log (section 3a).
2.3. Nature of the Service and what the Application and the Service are NOT. The Service is of an exclusively paramedical/wellness nature. In particular:
- the Service is not a health service within the meaning of the legislation on medical activity;
- the Application is not a medical device within the meaning of applicable law;
- neither the Service nor the Application constitutes a diagnosis or a medical assessment;
- neither the Service nor the Application constitutes medical advice or therapeutic recommendations;
- they do not replace a medical consultation or medical care;
- the Application does not analyze or interpret the content of the results made available on behalf of the Client.
2.4. The Application serves solely to make the Client’s paramedical/wellness assessment results available to them and is informational in nature.
2.5. Saving results to a file (export). The Client may share or save their result as a PDF file and, for results in the current format, may also generate from it an export file in JSON format intended for import into the Biohealer program. Saving takes place solely on the Client’s explicit command, to a location chosen by the Client. A file saved outside the Application remains under the Client’s sole control: the Application has no influence over it, cannot delete it, and does not automatically transmit it to any entity. The export file is a representation of the data from the result made available by the Practice – the Application Provider is not responsible for how it is used in third-party programs or for the operation of those programs. The Client is responsible for the secure storage and sharing of files saved outside the Application.
2.6. Information screen. The Application contains a “Vega Test – what it looks like” screen displaying an article from the Practice’s website (www.doctorvolovyk.com) in a mode adapted to the Application (without the website’s menu, footer, cookie banner, and analytics scripts). The content is informational in nature and is subject to clause 2.3 and section 5. Links leading outside the Practice’s website open in the system browser, outside the Application; the booking form available on the website is not displayed in the Application – appointments are booked in the Application in accordance with section 6.
3. Registration, access requirements, and the Account
3.1. Registration. An Account in the Application may be created by any person aged 16 or over who has an e-mail address – including a person who has not yet been a client of the Practice. Registration consists of: confirming the e-mail address with a one-time code sent to that address, providing first and last name, date of birth, and phone number, giving the Statements (clause 3.8), optionally indicating how the Client heard about the Practice, and setting a password. Creating an Account does not require a prior visit to the Practice or presence in the Practice records.
3.2. The Client is obliged to provide true and current data. The first and last name must be entered as they appear in identity documents – the Practice files results under these details, and any discrepancy (e.g. a diminutive, a different spelling) may prevent automatic Linking of results (section 5a). A person under 16 cannot be designated as the primary user; in such a case the Account is created by a parent or legal guardian, who adds the child as an Account member.
3.3. Accounts created before version 1.4. Accounts of clients whose e-mail address was in the Practice records retain access to results on the existing basis. At the first login after the update, the Application asks for the Statements to be given (clause 3.8); until they are given, booking appointments in the Application is not possible, while access to results remains available.
3.4. Login is performed using an e-mail address and either a one-time code (OTP) sent to that address or a password. The password is set by the Client after the first login with a one-time code and is stored solely as a cryptographic hash. Logging in to a Staff account additionally requires two-factor authentication (clause 3a.2).
Clauses 3.5 and 3.6 apply accordingly to persons using a Staff account, taking into account the obligations set out in section 3a.
3.5. The Client is obliged to keep login credentials (in particular the password and one-time codes) confidential and not to disclose them to third parties. The Client should set a password that is hard to guess and not used in other services.
3.6. The Client is responsible for actions performed within their Account until suspected unauthorized access is reported, within the limits set by law. If the Client suspects that login credentials have been disclosed or that the Account is being used by an unauthorized person, the Client should promptly notify the Practice at kontakt@doctorvolovyk.com.
3.7. Family account and Account members. The primary user may add Account members – family members, including children – by providing their first name, last name, and date of birth. A person under 16 is designated as a child; when adding them, the primary user declares in the Application that they are that person’s parent or legal guardian and gives, on their behalf, the consent required by the Practice. The primary user:
- provides and updates the data of Account members and of appointment participants and is responsible for its accuracy;
- declares that they are authorized to act on behalf of the Account members – in the case of children, as a parent or legal guardian;
- is responsible for bookings, cancellations, and confirmations of appointments made within the Account for Account members.
Accounts created before version 1.4 may indicate Account members from among persons in the Practice records on the existing basis.
The primary user may correct the data of an Account member added in the Application until results are Linked and provided no submitted request is under review. They may remove an Account member from the Account on the same conditions and, additionally, only when no appointment is scheduled for that person. After Linking, a change of data is made by submitting a request in the Application, reviewed by the Practice.
3.8. Statements given in the Application. The Application presents to the Client the information on the processing of personal data and the statements and consents required by the Practice: at Registration, when adding an Account member under 16, and – for Accounts created earlier – once after the update. Some Statements are required to use the Service (acknowledgement of the information on data processing, explicit consent to the processing of data concerning health for the purpose of performing the test/assessment and making the results available in the Application, the parent/legal guardian statement for a child), and some are voluntary (consent to a one-time e-mail contact after the visit, consent to voice calls regarding the appointment). The Application records the content (as a version and cryptographic hash), the decision, and the date of each Statement. A Client who has given the required Statements in the Application does not complete the paper statement at the Practice – the Practice is informed of this with every Booking. The content of the Statements is determined by the Controller. The required Statements include acceptance of these Terms and of the Privacy Policy (with the version date). A new version of the Statements invalidates the previous one – once it is introduced, the Application asks every Client to read the current texts and tick the required boxes again; until then, Booking in the Application is unavailable, while access to results remains. Consent is withdrawn by contacting the Controller, on the terms described in the Privacy Policy.
3.9. The Application is not intended for independent use by persons under 16; the Application is used solely by the primary user.
3a. Staff account
3a.1. Who uses a Staff account. A Staff account is intended solely for persons authorized by the Controller (Volovyk Clinic) to service the Practice’s clients. The authorization is granted solely by the Controller; it cannot be obtained through self-registration in the Application. A Staff account is not a Client’s Account: it has no Account members and does not serve to book appointments or to view one’s own results. A member of the Staff who wishes to use the Application as a Client creates a separate Account for that purpose, under a different e-mail address.
3a.2. Authentication and session. Logging in to a Staff account requires a password and two-factor authentication – a one-time code (TOTP) from an authenticator app registered at the first login. A work session is valid for no longer than 12 hours from logging in, and the Application logs the Staff account out after 5 minutes of inactivity. A login from a new device is signalled by an e-mail sent to the Staff account’s address and to the Practice’s internal address. The number of login and code-verification attempts is limited.
3a.3. Obligations of a person using a Staff account. A member of the Staff is obliged in particular to:
- keep the data of the Practice’s clients confidential, including data concerning health, also after the authorization ends;
- keep the login credentials and the second authentication factor confidential and not share the Staff account with other persons, including other members of the Staff;
- use the Staff account solely for the purpose of servicing the Practice’s clients and solely to the extent necessary to perform a specific task;
- promptly report to the Controller any suspicion of unauthorized access to the Staff account, including after receiving a message about a login from an unknown device;
- not save results outside the Application unless this is necessary to service a client and consistent with the Controller’s instructions.
3a.4. Limits and the access log. A Staff account shows solely the data of the persons whose service requires it. When a Staff account is used, the Application does not store results in the device’s cache, and at logout it removes from the device any files previously stored in that cache. Every opening of a person’s card, opening of a result, saving of an export file, and decision on the Linking of results is recorded in the staff access log (which member of the Staff performed which action and when – without first and last names and without the content of results). The log serves accountability purposes, is retained for 3 years, and remains in place also after a Client’s Account is deleted and after a member of the Staff has their authorization revoked; details are set out in the Privacy Policy. A member of the Staff can view their own entries in the log on their Staff account.
3a.5. Suspension. The rules for suspending a Staff account and revoking the authorization are set out in clause 10.5. A breach of the obligations set out in this section may also constitute a breach of the obligations arising from the legal relationship between the member of the Staff and the Controller.
4. Acceptable use
4.1. The Client undertakes to use the Application in accordance with the law, these Terms, and its intended purpose.
4.2. In particular, the following is prohibited:
- attempting unauthorized access to the Application, its systems, or the data of other persons;
- providing false data, including another person’s first and last name or date of birth, in order to gain access to another person’s results;
- creating an Account or adding an Account member on behalf of a person whom the Client is not authorized to represent;
- using another person’s Account or sharing one’s own Account with others;
- interfering with the operation of the Application, its security measures, or its infrastructure;
- taking actions that could disrupt the operation of the Service or compromise its security (including mass creation of Accounts or Bookings);
- using the Application for unlawful purposes.
4.3. Breach of the rules of use may result in suspension or deletion of the Account in accordance with section 10. The prohibitions set out in clause 4.2 apply accordingly to a Staff account; the additional obligations of members of the Staff are set out in section 3a.
5. Nature of the results and absence of medical advice
5.1. The results made available in the Application are of an exclusively informational and paramedical/wellness nature. They are an electronic representation of the paramedical/wellness tests and assessments performed by the Practice. They are not a medical diagnosis or medical records within the meaning of the legislation on medical activity.
5.2. The Service and the Application do not replace medical advice, consultation, or care and do not constitute a health service. In matters concerning health, interpretation of results, treatment, or therapeutic decisions, consultation with a physician is decisive.
5.3. The Client should not take or refrain from taking any action concerning their health solely on the basis of content made available in the Application (including on the information screen or in an export file) without consulting a physician.
5.4. In an emergency or where health or life is at risk, the Client should contact the emergency number or a healthcare facility.
5a. Linking of results to the Account
5a.1. Test and assessment results are made available in the Application only after they have been Linked to the Account or an Account member. Linking is carried out by the systems supporting the Service, without the Client’s involvement, according to the following rules:
- for Accounts created before version 1.4 – on the basis of the Practice records, as before;
- for Accounts created in the Application – automatically after a completed visit, when all of the following are met: (1) an appointment recorded in the Practice calendar (booked in the Application, on the website, or by phone) for the given person has taken place, (2) the Practice’s results archive contains a document marked with the date of that visit and that person’s first and last name, (3) there is no other person with the same first and last name in the Practice records.
5a.2. Automatic Linking usually takes place within a few days after the visit – once the Practice has placed the result in the archive. If within 5 days of the visit the result cannot be matched (e.g. due to a different spelling of the surname), or if there is another person with the same first and last name in the records, the case is referred for review by the Practice, of which the Client is informed by a message in the Application. Until the Practice decides, the results are not made available.
5a.3. Overriding principle: the Application never makes available another person’s results. In case of any doubt as to identity, the results remain unavailable until confirmed by the Practice. The Application Provider and the Practice do not guarantee that automatic Linking will occur in every case – in particular where the data provided by the Client does not match the data in the Practice’s archive.
5a.4. If the Practice refuses Linking (e.g. it cannot confirm identity), the Client sees a message in the Application asking them to contact the Practice; the results may be made available once the matter has been clarified with the Practice. A new Booking of an appointment in the Application restarts the Linking procedure.
5a.5. As of version 1.6 the first condition is established on the basis of the Practice calendar, so that Linking also works for appointments arranged on the website and by phone. A calendar entry is attributed to a person on the Account by the e-mail address given when the appointment was arranged (full match of the address). If the entry contains no e-mail address and only the first and last name match, the visit is not attributed automatically – the case is referred for review by the Practice in accordance with 5a.2. Appointments arranged by phone are not visible in the Application as Bookings; appointments arranged on the website are visible in it as Bookings where the calendar entry states the Account’s e-mail address. Regardless of Booking visibility, the calendar serves to establish that a visit took place.
6. Appointment booking, reminders, and notifications
6.1. Booking. The Application allows the Client to reserve an appointment slot at the Practice: choosing a service from the Practice’s price list (name, duration, price), choosing a free slot, and indicating the appointment participants from among the primary user and Account members (first and last name and phone number of each participant). The Booking is recorded in the Practice’s schedule (calendar). Booking requires the required Statements to have been given beforehand (clause 3.8).
6.2. Booking confirmation. After making a Booking, the Client receives a confirmation at the Account e-mail address (date and time, service, participants, Practice address, information about the Statements given and about the possibility of cancellation), and the Practice receives a copy of that confirmation at its internal reception address together with the Account e-mail address and information on whether the Statements were given in the Application.
6.3. A Booking made in the Application constitutes a reservation of an appointment slot at the Practice; the service itself is provided and paid for at the Practice (see clause 1.5). Prices shown in the Application come from the Practice’s price list.
6.4. Cancelling an appointment. The Client may cancel an appointment in the Application no later than 1 hour before its scheduled time. After that, cancellation in the Application is not possible – to cancel or reschedule, the Client should contact the Practice directly.
6.5. Reminders and appointment confirmation. On the day before the appointment, the Application sends a reminder (push notification and e-mail) asking the Client to confirm the appointment. The appointment can be confirmed in the Application or with a single tap on the notification (using a one-time token that allows only the confirmation of that appointment). The push reminder may be repeated if the appointment has not been confirmed.
6.6. Failure to confirm an appointment may result in its cancellation by the Practice. The Client is informed of a cancellation by the Practice through the available contact channels.
6.7. The Practice may refuse to accept a booking or cancel a booking in justified cases (including abuse, previous uncancelled no-shows); in such a case the Client may arrange an appointment directly with the Practice.
6.8. Message after the visit. If the Client has given voluntary consent in the Application to a one-time e-mail contact after the visit, on the day after a completed visit they may receive a message thanking them for the visit and informing them that the results will appear in the Application (the message may include a summary or a satisfaction survey to the extent covered by the consent). Without that consent, no message is sent.
6.9. Notifications. Push notifications require permission granted in the device’s operating system and can be disabled at any time in the Application or system settings. Disabling notifications does not restrict the other functions of the Application but may prevent receipt of push reminders about appointments. The content of notifications and e-mails contains only organizational details of the appointment (date and time, service, participants) – it does not contain test/assessment results.
6.10. Notifications about an earlier slot. The Client may subscribe in the Application to be notified when a slot becomes free on a chosen day or in a chosen period (up to 14 days ahead). The notification is sent by e-mail to the Account’s e-mail address and – where possible – as a push notification. A notification is not a Booking: slots are allocated in the order Bookings are made, so a slot may be taken before the Client makes a Booking. The subscription can be cancelled at any time in the “Visits” tab; it also expires on its own when the chosen period ends or when a Booking is made in that period.
6.11. Bookings, reminders, and appointment confirmations are organizational in nature (management of the Practice’s schedule) and do not constitute a health service, diagnosis, or medical advice.
7. Intellectual property
7.1. The Application, its code, interface, name, logo, graphic layout, and other elements are protected by law and belong to the Application Provider (Media Friends) or to entities from which the Application Provider has obtained the relevant rights. The content of the information screen (clause 2.6) comes from the Practice’s website and is subject to the rights of the Wellness Provider.
7.2. Use of the Application does not transfer any intellectual property rights to the Client. The Client obtains only a limited, non-exclusive, non-transferable right to use the Application within the scope of its intended purpose.
7.3. The paramedical/wellness test and assessment results and the Client’s data concerning health remain the Client’s data and are subject to separate rules set out in the law and in the Privacy Policy. The Client may save and share their own results (clause 2.5) at their own responsibility.
8. Service availability and disclaimer of warranties
8.1. The Application Provider (Media Friends) makes efforts to ensure that the Application operates correctly and is continuously available, but does not guarantee uninterrupted availability.
8.2. The Application is provided “as is”. To the extent permitted by law, the Application Provider gives no warranty of uninterrupted, error-free, or disruption-free operation of the Application.
8.3. Technical interruptions may occur due to maintenance, updates, failures, or the actions of third parties (e.g. infrastructure providers, notification delivery service providers, hosting of the Practice’s website). The Application Provider will, where possible, inform about planned interruptions.
8.4. The Application Provider does not guarantee delivery of every push notification or e-mail (delivery depends, among other things, on device settings, carriers, and external providers). Reminders are auxiliary in nature – the absence of a reminder does not relieve the Client of the duty to keep track of scheduled appointments.
8.5. The Application Provider does not guarantee that the Linking of results will occur automatically or within a specific time (section 5a); the time at which a result becomes available depends on the Practice placing it in the archive and on the consistency of the data.
8.6. The Application Provider may at any time modify, restrict, or discontinue provision of the Service at the technical level, with due regard for the Client’s rights under mandatory law and the Wellness Provider’s obligations regarding the results and data it maintains.
9. Limitation of liability
9.1. To the extent permitted by law, the Application Provider (Media Friends) is not liable for damage resulting from:
- inability to use the Application or interruptions in its operation;
- unauthorized access to the Account resulting from the Client’s failure to keep login credentials confidential;
- non-delivery of a notification or reminder for reasons beyond the Application Provider’s control (see clause 8.4);
- delay in or absence of automatic Linking of results resulting from a mismatch between the data provided by the Client and the Practice’s data (section 5a);
- the use, loss, or disclosure of files saved by the Client outside the Application (clause 2.5).
9.2. The Wellness Provider (Volovyk Clinic) is responsible, on the terms set out in the law, for the content and accuracy of the paramedical/wellness test and assessment results made available, for the provision of paramedical/wellness services, for the content of the Statements, for decisions on the Linking of results requiring review, and for managing the appointment schedule (including decisions to cancel unconfirmed appointments). To the extent permitted by law, the Application Provider is not liable for health decisions made solely on the basis of content made available in the Application, without consulting a physician.
9.3. The above limitations do not exclude or limit the liability of either entity to the extent that such liability cannot be excluded or limited under mandatory provisions of law, including consumer protection law and liability for personal injury.
9.4. The provisions of these Terms do not prejudice the rights of a Client who is a consumer under mandatory provisions of law.
10. Deletion and suspension of the Account
10.1. Deletion of the Account by the Client. The Client may delete the Account at any time through the Application (menu → “Delete account”). In addition, the Client may contact the Practice at kontakt@doctorvolovyk.com.
10.2. Deletion of the Account results in loss of access to the Application and deletion of the login data, registration data, the list of Account members, device tokens, and the record of Statements given. Files saved by the Client outside the Application are not deleted. After withdrawal of consent or deletion of the Account, the Controller (Volovyk Clinic) may retain a necessary, limited scope of data (including the booking-event log, the results-Linking log, entries in the staff access log, and the entries in the Practice records serving to distinguish persons with the same first and last name) for the limitation period of civil claims – on the basis of Article 6(1)(f) GDPR (legitimate interest: establishment, exercise, or defence of legal claims and data security). Detailed rules on data retention and deletion are set out in the Privacy Policy.
10.3. Suspension or deletion of the Account. The Account may be suspended or deleted by the Application Provider (for technical or security reasons) or at the request of the Wellness Provider, in the event of:
- breach of these Terms, in particular the rules of use (section 4);
- suspected unauthorized access or abuse, including providing false data in order to gain access to another person’s results;
- the Practice being unable to confirm the Client’s identity;
- termination of the Client’s relationship with the Practice;
- where required by law or by data security.
10.4. Where possible, the Client will be informed of the suspension or deletion of the Account, unless the law or security considerations provide otherwise.
10.5. Suspension of a Staff account and revocation of the authorization. A Staff account is suspended and the authorization revoked without delay in the event of:
- loss of the authorization, in particular the end of the member of the Staff’s cooperation with the Controller;
- breach of the confidentiality obligation or of the other obligations set out in section 3a;
- suspected unauthorized access to the Staff account or abuse;
- where required by law or by data security.
Revoking the authorization ends all work sessions in progress. Entries made earlier in the staff access log remain in place (clause 3a.4).
11. Protection of personal data
11.1. The rules for processing the personal data of the Client and Account members, including data concerning health, are described in the Privacy Policy available at https://www.doctorvolovyk.com/privacy-policy-app/ and in the Application, which constitutes a separate document.
11.2. The controller of the Client’s personal data is Volovyk Clinic Sp. z o.o. (Wellness Provider). Media Friends Sp. z o.o. processes the Client’s personal data as a processor on behalf of and on the instructions of the Controller, on the basis of a data processing agreement (Article 28 GDPR).
11.3. The legal basis for processing the Client’s data concerning health is their explicit consent (Article 9(2)(a) GDPR), given in the Application (clause 3.8) or – for Clients who gave it earlier – at the Practice. Consent may be withdrawn at any time, without affecting the lawfulness of processing carried out before its withdrawal. Data related to handling bookings, reminders, and the account is processed to the extent necessary for the performance of the Service (Article 6(1)(b) GDPR); the record of Statements given and the results-Linking log are kept in order to demonstrate consent and ensure data security, and the staff access log is kept for the accountability of access to data (Article 6(1)(c) GDPR in conjunction with Article 32 GDPR and Article 6(1)(f) GDPR); details are set out in the Privacy Policy.
11.4. The Client’s rights concerning personal data (including access, rectification, restriction of processing, withdrawal of consent) are handled by the Controller, i.e. Volovyk Clinic. Details on the legal bases of processing, data recipients, retention periods, and the Client’s rights are set out in the Privacy Policy.
12. Changes to the Terms and effective date
12.1. The Application Provider (Media Friends), in consultation with the Wellness Provider to the extent concerning it, may amend these Terms for important reasons, in particular in the event of changes in the law, changes in the functionality of the Application, or security considerations.
12.2. The Service Provider informs Clients of amendments to the Terms at least 14 days in advance of their entry into force, in a manner enabling them to review the amendments (e.g. a notice in the Application or a message to the e-mail address provided). A Client who does not accept the amendments may terminate the agreement / stop using the Service before the amendments enter into force. Acceptance of a new version of the Terms takes place in the Application (point 3.8).
12.3. These Terms were published on 2026-10-09 and apply from 2026-10-26 (previous version dated 2026-09-01).
13. Governing law, contact, and dispute resolution
13.1. Governing law. These Terms are governed by Polish law. This provision does not deprive a Client who is a consumer of the protection afforded by mandatory provisions of the law of their habitual residence.
13.2. Contact. For technical matters concerning the Application and these Terms, the Client may contact the Application Provider (Media Friends) at: hello@mediafriends.pl. For matters concerning paramedical/wellness services, test and assessment results, the Linking of results, appointments, and personal data (as the Controller), the competent entity is the Wellness Provider (Volovyk Clinic) at: kontakt@doctorvolovyk.com.
13.3. Out-of-court consumer dispute resolution. A Client who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including: (a) the European Union online dispute resolution (ODR) platform available at https://ec.europa.eu/consumers/odr; (b) the assistance of permanent consumer arbitration courts, provincial inspectorates of the Trade Inspection, and district (municipal) consumer ombudsmen. Use of these methods is voluntary.
13.4. Disputes not resolved amicably are subject to resolution by the competent court in accordance with the law.
